Successful Arbitration Between Jason Lamarre (the affiliate) and ACF Webmasters (affiliate company for Casino770, CasinoRiva and Poker770)

On Monday November 9, 2009, Jason Lemarre approached Paul White, Chairman of the Gambling Affiliates Union and requested GAU help in negotiating the release of unpaid affiliate income being held by ACF Webmasters.

After studying the documents provided by Jason, the GAU decided that his case had merit and that we would contact ACF on his behalf.

Documents that were supplied were as follows:
Three contracts
Emails exchanged with ACF
csv file containing player stats

Contracts
The contracts referred to a hybrid commission deal between ACF and Jason Lemarre where ACF agreed to pay the affiliate a CPA plus Revshare on every real money player the affiliate generated, provided the player made a minimum deposit.  There were no other conditions present in the contracts.  The contracts were in effect for the earning period  that the commissions in question had been generated.  All three contracts were identical except for the start / end dates.  The third and final contract was effective for the following dates:
Starting Date:  1/11/2009
Ending date:    1/5/2010

Emails
We reviewed the emails exchanged between the affiliate and ACF and concluded that ACF was freezing the affiliate’s account due to fact that the affiliate was incentivising players.

Conclusion
After an exchange of emails and telephone calls with Nathan Vicks at ACF along with numerous emails from Jason, we pointed out to Nathan that the affiliate had met all terms of his contract, we also proved that Jason had actually incentivised his players to play more and not incentivised them to sign up. After all discussions were concluded Nathan agreed to pay the affiliate in full and honor their contract with him.

This payment was made and received by Jason within 24 hours of the conclusion of arbitration and within 48 hours of Jasons first contact with Paul White.

In closing, we would like to thank ACF Webmasters for their professional attitude and their willingness to resolve this matter in a timely manner.
