Warning – Bookmaker.com Not Affiliate Friendly

One of our primary mandates is to ensure affiliates are aware of predatory affiliate program terms and conditions.
It has come to our attention that Bookmaker.com has retroactively added a quota to their terms and conditions. From what we’ve been able to discover, Bookmaker.com changed their terms and conditions some time late in 2007.
Please note – these terms are not affiliate friendly! Even the largest affiliates can have a difficult time attaining the quota.
While all quotas leave a bad taste in my mouth, this one actually makes me vomit. Affiliates beware!!
3.2. Affiliate is required to refer a minimum of 10 active customers during the previous week to withdraw/transfer their earnings. If the affiliates chooses to close the affiliate account before reaching the required 10 active players, any and all commissions shall be forfeited.
3.8. Affiliate is restricted from utilizing derivatives of “Bookmaker” in URLs and directory names for the intention of search engine optimization.
3.10. Affiliate is restricted from optimizing any page of their website(s) for keyword or keyword phrases that include, but are not limited to, Bookmaker, Bookmaker.com, Bookmaker Brand, Bookmaker Sportsbook, Bookmaker Casino, Bookmaker Racebook, Bookmaker Poker or Bookmaker Sportsbook, Casino and Poker Room in any format. This includes, but is not limited to, meta tags, headers and body content.
4.1
Commission fees will be based on a percentage on the Net Revenue Share Model, on the amount of revenue generated by you in any one month. You’ll earn from 25% to 40% of the net revenues from sportsbook, racebook, casino, bingo and poker. The percentage breakdown is as follows:

$0 – $20,000 net player losses monthly 10 active players weekly * 25
$20,001 – $40,000 net player losses monthly 60 active players weekly 30
$40,001 – $60,000 net player losses monthly 100 active players weekly 35
$60,000+ net player losses monthly 200 active players weekly 40
* Note: Affiliate is required to have a minimum of 10 active players during the previous week to withdraw/transfer their earnings.
* We reserve the right to raise or lower any affiliates’ commission rate solely at Management’s discretion.
b. If a player signs up under an affiliate account and does not make a deposit within the first 60 days, that player becomes a house account.
4.2.
a. Bookmaker.com shall pay monthly, in accordance with this contract. If Affiliate commissions earned do not exceed two hundred dollars ($200.00 USD), then payment will be carried over to the following month until they exceed $200.00 USD. If an Affiliate does not request a payout, their balance will carry over until the next pay period.

They stole millions from small webmasters and affiliates with this rule in place. They owe me personally over $1,000 (which is still growing) which I will NEVER see because the 10 active player rule is impossible to meet for a small time affiliate. The response that the affiliate managers give is that this was a decision of their CEO.
Conversions are absolutely terrible, on top of that, how can they expect any webmaster to advertise for them without using:

BE CAREFUL WITH THIS ONE !!!!!!! ….
What they will do is wait til you get sign-ups and conversions, reach your quota then turn around and say, “you violated their terms by mentioning their brand.” Then they will turn around and terminate your account and keep your sign-ups.
Search the web, it won’t take you long to find info how they stole from affiliates. You don’t meet the quota, they keep your sign-ups, you do meet the quota, they will find say you violated their terms, terminate you account and keep your referrals anyways.

Yes, this happened to me but now i have so much commission owed by bookmaker, betcris and diamond that I am really pushing hard to get my minimum quota!
I negotiated my quota down to 7 and I am pretty close to getting it as they have some decent offers at Bookmaker this month!

If Bookmaker.com really wanted you to reach your quota then the following would not be a condition of their terms:
“4.1
b. If a player signs up under an affiliate account and does not make a deposit within the first 60 days, that player becomes a house account.”
Your job as an affiliate is to refer players and sign-ups, with rules such as the preceding in place it makes it impossible to recruit in the off season.
Look at all their terms as a whole, it’s specifically designed to strip an affiliate from their referrals.
Also:

I’m not even sure if this is legal under Costa Rican law (where they reside.) This is like saying your hired for the job but if you don’t like me as a boss and quit after working 36 hours you won’t be paid for the hours you worked because you didn’t put in a 40 hour work week.
All in all, as said before, read the terms in entirety, they are quite surreptitiously designed to work against ANY affiliate, big or small, and are written with the intent to flat out steal from you.
These terms are completely unacceptable and predatory. BOTTOM LINE.

Simon Skinner, this is exactly what they wanted you to do when they made this rule. They have shfted the balance of power completely in their favor and now have you ready to accept any wacky rule they throw your way. Affiliate deals should be a partnership, not one side dictating to the other what and how to conduct business. They owe me $3,000+ dollars and froze me out of my afffiliate account when I called and complained. And the new manager their cursed at me on the phone. His name is Kevin. Bookmaker is a scam. Bottom Line.
